Terms of Service
T Rose Etc. L.L.C. will provide estimates at no cost, in-person, over the telephone and via email. Please recognize that it's only an estimate and the final price may be higher or lower due to: Increased cost of materials, travel to deliver or installation, customer requested project changes after original estimate is given, and other unforeseen fabrication issues.
For garments and decor, clients are required to select and purchase their own fabrics, whenever possible, as I cannot predict another persons taste. I will be happy provide you with a yardage estimate. All design related services require a one-to-one consultation. Alterations may require one or more appointment for measurements, fitting and consultation. Each product is made to order according to your requirements, subject to the availability of materials. Most orders require 7 to 14 days to complete depending on the availability of the parts or material and the amount of work already in the que. Please be aware that completion and delivery of finished items is on a first-come, first-served basis.
For an estimate on alterations or repair work, please contact me directly at email@example.com and/or call me at 970-388-7164. In some cases, it is a standard repair and I can quote it over the phone. In most cases, I will need to see the actual product and source the repair parts prior to making an estimate.
If you are shipping your repair to me, please use the repair form. You can email to request a repair form, Print one from this site, or just provide the information on the repair form on your own. The postal service can do some really interesting things. Packackage your articles carefully and include the form in each package. Customers are expected to pay shipping costs to and from. I will call you or email you, as soon as I can, to let you know that I have received your article(s) and let you know what your estimated repair costs. Once your payment arrangements have been made, the work will begin.
Custom window treatments require an on-site consultation to measure your windows, and interpret your vision. I use only Graber products for new blinds and cellulars. Shades and draperies are made or re-vised as customized.
Blind repairs do not usually require an in-home consultation but are handled on a case by case basis. It is ideal for them to be dropped off or shipped to my office to be returned in the same manner. Please use the Repair Form from the above tab. I can do take-downs and re-installs in the region by appointment, if needed, for an additional charge.
Your satisfaction is very important to me. With any alteration or repair, there are limitations as to what can be successfully achieved. I retain the right to refuse service when the scope of the work required is outside my expertise or is in defiance of the laws of nature. I will always communicate, clearly and concisely, if the desired alteration, adjustment or repair is feasible, or is just simply not possible. I will always discuss with you possible alternatives to meet your objectives.
Payment for service is required at the time of service. You will be informed of the your projects progression within the work que, and the anticipated completion and delivery dates, upon receipt of payment confirmation in the form of a personal check, credit card, cash, or money order. If material availability will effect the order, you will be advised.
T Rose Etc. L.L.C. shall incur no liability or penalty for delays due to state of war, civil disorder, fire, strikes, accidents, action of Government or civil authorities and acts of God, hurricane or flood, or other causes beyond our control.
Terms of Payment
Prepaid in full with Cash, Credit Card + 3% upcharge for service or Check.
3. Method of Payment:
Cash - U.S. funds
Checks - T Rose Etc. L.L.C. accepts personal and business checks (no counter checks, or third party checks) in US funds, drawn on a bank located in the United States. Checks should be made out to Teresia R. Reed. A 20% service fee will be charged for all returned checks, and item will not be delivered until payment has cleared.
Credit Cards - Visa or Master Card + 3% upcharge for service or Check.from the website, a credit card is required.
Pay Pal - Is accepted in all transactions.
4. Returns, Refunds and Exchanges:
Orders for Handcrafted Custom Specialties of any kind, or alteration(s), or custom sizing, cannot be returned for refund or exchange under any circumstances.
Under no circumstances will Standard Shipping and Handing, or either Priority or Express Handling Charges be refunded.
Disclaimer of Warranty
The products covered by these Terms of Sale are provided "as is," without a warranty of any kind. All express or implied representations and warranties, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement, are hereby excluded to the extent permitted by law.
Limitation of Liability
In no event shall T Rose Etc. L.L.C. be liable for any lost revenue, profit, or for direct, indirect, special, consequential, incidental or punitive damages however caused and regardless of theory of liability arising out of the use of or inability to use the product covered by the Agreement, even if T Rose Etc. L.L.C. has been advised of the possibility of such damages. In no event will T Rose Etc. liability in connection with the scope of the sale exceed the stated selling price paid to T Rose Etc. L.L.C by the Customer.
In the event that T Rose Etc. L.L.C. shall begin any litigation to enforce the terms of the Agreement, then the Customer shall pay T Rose Etc L.L.C. court costs and reasonable attorneys fees.
Invalidation of any of the provisions, covenants, or restrictions of these Terms of Sale, by judgment or court order, shall in no way affect any other provision, covenant, or restriction, which shall remain in full force and effect.
In the event statements exist in accompanying agreements, exhibits or attachments, that are, or may be determined to be in conflict with any statements made herein, the Customer acknowledges and agrees that said statements are hereby replaced with and superseded by those found herein.
Governing Law :
This agreement shall be governed and interpreted under the laws of the State of Colorado, USA, as now or hereafter may be in existence.
Customer acknowledges and understands and agrees that this agreement shall be construed and enforced under the laws of the State of Colorado, USA. Customer further acknowledges that T Rose Etc. L.L.C is located in Rio Blanco County, Colorado, USA and that the Customer is aware of the exact geographic location of Rio Blanco County within the state of Colorado,USA.
Customer further acknowledges that the Agreement is both factually and legally made in Rio Blanco County, Colorado, USA. Customer further understands that any litigation may require that the customer pay for the costs and expense of witnesses, travel, lodging, meals, attorneys fees and other unknown amounts necessary for the Customer to maintain any litigation. Customer accepts the responsibility of bearing all of the above costs and any other necessarily and properly related thereto as part of the costs and economic burden of conducting business.
As a consequence of understanding all of the above, Customer agrees and understands that any litigation commenced to enforce any term, condition, obligation, right or responsibility stated or implied above shall be brought in Rio Blanco County, Colorado,USA.
